| The draft UNCITRAL Legislative Guide to Secured Transactions may make your eyes glaze over. But this international law initiative to improve the ability of enterprises to acquire financing threatened to regulate intangible as well as tangible assets posing a threat to all businesses involved in IP licensing. As the initiative sauntered through the UN approval process, a small group of IP practitioners awoke to its significance and sought to change some of the provisions. However, after seven years of negotiation, proponents of the Guide would not accept fundamental changes easily. Cunning, determination and teamwork has led to a compromise that will please IP owners, but there is still more work to be done. |
