While attention on the European patent system is being focused on amendments to the European Patent Convention and implementation of a Community Patent, even more fundamental proposals are being considered which will change the way in which foreign judgements in civil matters are dealt with. These proposals aim to amend the Brussels Convention on Jurisdiction and Enforcement of Judgements in Civil and Commercial Matters. They unfortunately fail to address current shortcomings in the patent system.
